By accessing or using Postie ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. Your continued use of Postie constitutes acceptance of any updates or modifications to these terms.

2. Description of Service

Postie is a mobile application that enables users to send physical postcards from digital photos. Users can upload photos, customize postcards, and have them printed and mailed to recipients anywhere in the world. The Service includes the mobile application, website, and all related services and features.

3. User Accounts

To use certain features of Postie, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You must be at least 13 years old to create an account. If you are under 18, you must have parental consent to use the Service.

4. User Content

You retain ownership of all photos and content you upload to Postie. By using our Service, you grant Postie a limited, non-exclusive license to:

• Print your photos on physical postcards
• Process and transmit your content to fulfillment partners
• Store your content for order processing and account history

You represent that you have the right to use and share any content you upload, including necessary permissions for photos containing other individuals.

5. Prohibited Uses

You agree not to use Postie to:

• Send content that is illegal, obscene, defamatory, or infringes on others' rights
• Harass, threaten, or intimidate any person
• Send unsolicited commercial communications (spam)
• Impersonate any person or entity
• Upload content containing malware or harmful code
• Attempt to gain unauthorized access to our systems
• Use the Service for any fraudulent or illegal purpose

6. Payment Terms

Postie uses a credit-based system for sending postcards. By purchasing credits:

• You agree to pay the listed price at the time of purchase
• Credits are non-refundable except as required by law
• Prices may change; existing credits remain valid at their purchased value
• Credits do not expire while your account remains active

Refunds for defective or undelivered postcards will be reviewed on a case-by-case basis. Contact support for assistance with order issues.

7. Intellectual Property

The Postie name, logo, and all related branding are trademarks of Postie. The Service, including its design, features, and functionality, is owned by Postie and protected by intellectual property laws. You may not copy, modify, or distribute any part of our Service without explicit permission.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee:

• Specific delivery times for postcards (typical delivery is 5-10 business days)
• Uninterrupted or error-free operation of the Service
• That postcards will be delivered to incorrect addresses provided by users

Delivery times vary by destination and postal service conditions. We work with reliable fulfillment partners but cannot control third-party postal services.

9. Limitation of Liability

To the maximum extent permitted by law, Postie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claims related to the Service shall not exceed the amount you paid to Postie in the twelve months preceding the claim.

10. Termination

You may close your account at any time through the app settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct harmful to Postie or other users. Upon termination:

• Unused credits may be forfeited
• Pending orders will be completed
• Your content may be deleted after a reasonable retention period

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes through the app or by email. Your continued use of Postie after changes are posted constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
